1) Who We Are & Contact

These Terms govern your use of Arcade Mart’s website and mobile apps (the “Service”). “Arcade Mart,” “we,” “our,” and “us” mean Arcade Mart LLC, 4705 S Durango Dr #100-69, Las Vegas, NV 89147. Phone: 725-373-2528. Email: Support@ArcadeMart.com.

2) Eligibility & Accounts

  • You must be at least 18 and provide accurate information. One account per person.
  • You’re responsible for maintaining the confidentiality of your credentials and for activity on your account.
  • We may suspend or terminate accounts for suspected fraud, abuse, or illegal activity.

3) Orders, Pricing & Estimated Tax

  • Order Acceptance. We may accept, refuse, or cancel any order at our discretion, including due to errors in pricing/availability or suspected misuse. If a change is needed, we’ll contact you or cancel and refund.
  • Prices & Fees. Prices, fees, and promotions are subject to change until your order is fulfilled.
  • Estimated Tax. Taxes shown at checkout are an estimate and may vary based on final fulfillment and delivery location.
  • Risk of Loss. Risk transfers upon delivery to the address or delivery location you designate (including unattended delivery, if authorized).

4) Grocery-Specific Terms

  • Substitutions. Unless you opt out at checkout, you authorize us to provide comparable substitutions. If a substitute costs less, you’re charged the lower price; if more, you authorize the difference. If no substitute is available, we’ll remove the item and refund/credit it.
  • Weight-Based Items. You authorize charges based on the final measured weight at the per-unit price shown. Your final total may differ from the estimate.
  • Out-of-Stock Handling. Items may be canceled, substituted, or credited at our discretion per your preferences.
  • Delivery Windows & Delays. Windows are estimates. We’re not liable for delays caused by events beyond our control (weather, traffic, carrier constraints, force majeure).
  • Unattended Delivery & Temperature-Sensitive Goods. If you authorize unattended delivery, risk of loss/theft/spoilage passes on placement at your location. Please retrieve perishables promptly.

5) Payments (Stripe)

  • We use third-party processor Stripe to accept cards and other payment methods. By submitting a payment, you authorize us and Stripe to charge your selected method for order totals, adjustments (e.g., substitutes, weight variance), taxes, and fees.
  • Saved payment methods are tokenized and stored by Stripe. We don’t store full card numbers on our servers.
  • Failed/chargeback payments may lead to order cancellation or account limitations.

6) Loot, Promotions & Rewards

  • “Loot,” promotional credits, coupons, and rewards have no cash value, may expire, are subject to verification, and can be revoked for fraud/abuse/error.
  • Unless stated otherwise, promotions cannot be combined and apply to in-stock items only.
  • We may modify or discontinue promotional programs at any time.

7) Store Credit Wallet

  • Store credit may be automatically applied at checkout. It’s non-transferable and only redeemable for purchases at Arcade Mart.
  • Where required by law, small remaining balances may be cash-refundable; see our Refund Policy for details.
  • Credits from returns appear after processing. If you used multiple tenders, refunds may be split between the original method and store credit.

8) Privacy, Communications & Account Deletion

  • Your use of the Service is also governed by our Privacy Policy.
  • By using the Service, you consent to receive transactional communications (email/SMS) about your orders and account. For SMS terms/consent, see our Privacy Policy.
  • Account Deletion. You may request deletion of your account and personal data through the app or by emailing Support@ArcadeMart.com. We’ll honor requests subject to legal/record-keeping obligations.

9) Intellectual Property & Acceptable Use

  • The Service and all content are owned by Arcade Mart or our licensors. You receive a limited, non-exclusive, revocable license to use the Service for personal, non-commercial purposes.
  • You agree not to misuse the Service (no scraping, reverse-engineering, interfering with security, or fraudulent orders/chargebacks).

10) Disclaimers & Limitation of Liability

  • The Service is provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied.
  • To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amounts you paid to Arcade Mart for the order giving rise to the claim in the 12 months preceding the event.
  • We’re not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

11) Arbitration, Class-Action Waiver & Governing Law

To the fullest extent permitted by law, any dispute will be resolved by binding arbitration on an individual basis in Clark County, Nevada, administered by a recognized provider under its rules. You waive the right to participate in a class or representative action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing Support@ArcadeMart.com with subject “Arbitration Opt-Out.” These Terms are governed by the laws of the State of Nevada, without regard to its conflicts of laws principles.

12) Changes to these Terms

We may update these Terms prospectively by posting a new date above. Material changes will be notified via email or in-app notice. Your continued use of the Service after changes constitutes acceptance.
